CLOUD Act, FISA 702: your data on AWS or Azure is not sovereign
The CLOUD Act (2018) allows US authorities to demand access to data stored by American companies, regardless of the hosting country. Even an AWS server in Paris is subject to this law.
The FISA Section 702 authorizes mass surveillance of non-Americans' communications. Databases hosted on US cloud providers are legal targets of this surveillance.
The Schrems II ruling by the CJEU (2020) invalidated the Privacy Shield and confirmed that data transfers to the United States do not guarantee an adequate level of protection. Standard Contractual Clauses (SCC) are a legal patch, not a technical solution.
The only reliable protection is structural: host your data with a European operator, on European infrastructure, subject exclusively to European law.
